- Paragraph 3 of the order dated 29/01/2024, passed by the Hon'ble Supreme Court of India [Coram: The Hon'ble Ms. Justice Hima Kohli & the Hon'ble Mr. Justice Ahsanuddin Amanullah] in Special Leave to Appeal (Civil) 12660/2023 [Soumen Paul & Ors. Vs. Shrabani Nayek & Ors.] WITH Special Leave to Appeal (Civil) 25324/2023 [Arindom Marjit & Ors. Vs. State of West Bengal & Ors.] WITH Diary no. 25090/2023 [IA No. 194591/2023] reads infra:
- Having regard to the fact that as against 11, 758 posts in different subjects in various categories in all districts of the State of West Bengal, the respondents have found only 9, 533 eligible candidates, including the additional panel of 5% candidates, it is deemed appropriate to permit the respondents to declare the merit list with a rider that it should be stated in clear terms that the appointments made shall be subject to the outcome of the present petitions. The letters of appointment to be issued to the successful candidates shall also specifically state that their appointments will be subject to the outcome of the present petitions."
- As directed, by Their Lordships, in the above matters, the State-wide Merit List (Vacancy-wise, Medium-wise, Category-wise) [prepared by the Selection Committee and approved by the Ad-hoc Committee of the West Bengal Board of Primary Education] of 9,533 eligible candidates, including the additional panel of 5% candidates, found suitable for recommendation and/or
appointment in the 2022 primary teachers' recruitment process in West Bengal, is hereby published and/or declared and/or enclosed with this notification in the official website of the Board.
- In furtherance to such publication/declaration, as a recommending body, the West Bengal Board of Primary Education hereby recommends the selected candidates (Vacancy-wise, Medium-wise, Category-wise), to the respective District Primary School Council(s)/Primary School Council (s), for issuance of appointment letters.
- It is made abundantly clear that these recommendations by the Board and/or issuance of appointment letters by the respective District Primary School Council(s)/Primary School Council(s) are made subject to the final result/outcome of Special Leave to Appeal (Civil) 12660/2023 [Soumen Paul & Ors. Vs. Shrabani Nayek & Ors.] WITH Special Leave to Appeal (Civil) 25324/2023 [Arindom Marjit & Ors. Vs. State of West Bengal & Ors.] WITH Diary no. 25090/2023 [IA No. 194591/2023].
- The respective District Primary School Council (s)/Primary School Council(s), prior to issuance of appointment letters, to the recommended candidates must strictly adhere to the directions contained in paragraph 3 of the order dated 29/01/2024 passed by the Hon'ble Supreme Court of India [extracted/quoted in paragraph 1 hereinabove], upon indicating such condition in the appointment letter of the recommended candidate.
